The obligation to conclude a agreement has been imposed for sales carried out over the Internet in accordance with “Regulation on application procedures of Distant Agreements” published in the official gazette dated 13.06.2003 and numbered 25137. The agreement details are as follows.
1- The Parties
The service provider is ERBİZ OTELCİLİK TURİGIDA SANAYİ VE TİCARLTD.ŞTİ. It is referred to as the “hotel”.
The person and/or institution whose name, surname is indicated in the reservation will be referred to as a “Consumer”.
In accordance with this agreement, the Hotel is obliged to provide accommodation at the Hotel at the request of the Consumer.
Hotel confirms that with the signing of this agreement, the Consumer is informed about the rules of hotel accommodation, booking rules and tariffs.
From the moment this agreement is concluded, the Hotel will confirm the Consumer’s request.
3- Duration of the Agreement
If this agreement enters into force on the date of approval of this reservation by the Hotel and no dispute arises, it will automatically terminate when the service that the Consumer receives is over. In the event of a dispute, this agreement relationship will be valid for the period up to the final settlement of the dispute.
- Type of Accommodation
Accommodation is in the concept of “Room Only”.
The age and identity of the Consumer will be checked at the time of check in. The Consumer will cover the expenses incurred due to incorrect information provided by the consumer.
The consumer will agree that no matter what time he arrives at the hotel, he will check into the room at the earliest on the day of check-in to the hotel at 14:00, and no matter what time he leaves the hotel, he will check out of the room at the latest at 12:00, and he will pay for additional service that will be provided to him after checking out of the room.
Pets are not allowed at the hotel.
5- Cancellation / Refund and Change
Other than documented force majeure circumstances (death, accident, etc.)
When the consumer requests cancellation until 5 days before the start of the service, the entire service price he has paid will be refunded to him.
If the consumer refuses the service for any reason other than the fact that the Hotel has not fulfilled its responsibilities after check in the hotel, the payment made will not be refunded.
If the consumer requests a cancellation less than 5 days before the start of the service, the 1-day price of the selected room will be deducted from the reservation as withdrawal compensation.
These terms do not cover promotional services, early bookings or discounted bookings.
Cancellation provisions are applied for date changes made by the consumer.
The consumer agrees that he will comply with the rules of the service agreement regarding the service purchased from the Hotel; he will respect the life, property and peace of the 3rd persons, otherwise he will not be able to get the service for the right reason and he has no right for refunding.
4- Payment and Billing Information
When purchasing services by credit card, the Consumer is obliged to pay the service fee at the time of booking.
According to the prices specified in the service price, VAT is included.
The consumer will provide the Hotel employee with the credit card he used to pay for when registering an online reservation or a photocopy of the front part of this credit card at the time of check in. The Consumer will be responsible for the damages/ loss caused by the Consumer’s failure to fulfill these responsibilities.
The invoice will be issued to the Consumer upon receipt of the service at the time of check-out from the Hotel. If the consumer does not receive the invoice at the time of check-out, it will be sent to the address specified by the Customer. If the Consumer has not specified the address to send the invoice, the invoice will be sent to his contact address. The Hotel will not be held responsible for the non-receipt of the invoice if the consumer specifies a wrong address or does not specify the recipient, or the recipient is not available at the specified address.
Consumer credit cardnumber is encrypted with SSL security certificate on our website and forwarded to his bank and it is never shared with third parties and it is not stored. Our company works with the 3D secure security verification (SMS) infrastructure.
The time for issuing invoices for the purchased service is 7 days accrding to V.U.K, including the date of purchase, provided that the month is not skipped.
For credit card payments, the difference in the maturity determined by the relevant bank or payment systems in the installment payment options selected by the customer is added to the service price and is automatically indicated in the installment payment table.
The costs arising from the cancellation and refund of credit card payments made to the bank’s pos system or the company providing payment systems services are deducted from the amount to be refunded to the customer.
- Other Provisions
Adverse weather conditions, strikes-lockouts, terrorism, military operations, floods, fires, etc. technical unpredictable situations will be considered force majeure. In the event that such situations occur, the Hotel may not continue to provide services.
The hotel has the right to change the prices specified on the website, and the specified prices are in limited number.
When it is necessary to resolve disputes arising in accordance with this agreement Republic of Turkey Izmir courts and enforcement agencies are authorized.
Password, username, credit card information or other personal information is never requested from consumer by our company via e-mail. This application, called “Phishing”, is a scam aimed at stealing your personal information. When you receive a message that appears to be from us, but requests your personal information, you should not respond.
